These Terms of Service ("Terms") govern your use of the website operated by Down to Earth Tree Service ("we," "us," or "our"). By accessing or using the site, you agree to be bound by these Terms.

1. Use of the Site

You may browse the site, request quotes, sign up for our newsletter, and read educational content. You agree not to use the site for any unlawful purpose, to harass or harm others, to attempt to gain unauthorized access to any part of the site, or to interfere with the proper functioning of the site.

2. Estimates and Quotes

Any pricing, timeline, or scope information shared through the website (including responses to contact-form submissions) is preliminary and not a binding offer until a written or verbal estimate is provided after on-site assessment. Final pricing depends on factors that can only be confirmed in person, including but not limited to tree size, lean, proximity to structures and utilities, access, debris volume, and soil conditions.

3. Services

Tree removal, tree trimming, stump grinding, shrub removal, and land-clearing services are performed only after a written or verbal agreement on scope and price between Down to Earth Tree Service and the customer. Services are provided in accordance with industry-standard safety practices. We carry general liability and workers' compensation insurance; a certificate of insurance is available upon request.

4. Customer Responsibilities

The customer is responsible for accurately describing the work area and access conditions, identifying any property lines or known underground utilities not marked by a 811 call, removing valuables from the work area, and providing legal authority to perform the work (e.g., HOA approval, easement permission). The customer is responsible for marking any private utilities (irrigation, low-voltage lighting, septic lines) that public locate services will not cover.

5. Intellectual Property

The text, photographs, logos, and overall design of this site are the property of Down to Earth Tree Service or are used with permission. You may not reproduce, redistribute, or use site content for commercial purposes without prior written consent.

6. Third-Party Links and Services

The site may link to third-party platforms — including but not limited to Google (Maps, Search Console, Analytics), Resend (email delivery), Vercel (hosting), and Neon (database). Your interaction with those services is governed by their own terms; we are not responsible for their content or practices.

7. Disclaimer of Warranties

The site and all content on it are provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of viruses.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Down to Earth Tree Service will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the website. Our total liability arising out of or relating to these Terms is limited to one hundred United States dollars ($100). This section does not limit liability that cannot be limited under applicable law.

9. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the site will be brought exclusively in the state or federal courts located in Georgia.
